Supreme Court Falling Standards




Recently Supreme Court has made some right observations on its own falling standards. One such case is that relating to the Government subsidizing Haj Pilgrimmages of one particular community, justifying it on the ground of the amount involved being too small. The constitutional provisions in this regard specifically bar any such subsidy, irrespective of the amount involved. It is such small compromises on the basic features of our constitution that has resulted in the erosion of the basic features of our constitution, resulting in lot many maladies This is basically because the judiciary is not totally independent of the executive. Right from appointment to retirement & post retirement assignments, judiciary is under the thumb of the Government. It is therefore essential that our judiciary is made truly and absolutely independent of the govt. including its administration, finance etc. as proclaimed in the preamble of our constitution. Otherwise citizens cannot expect true justice through our legal institutions. In fact this lacunea is at the root of undue delays in the dispensation of justice and accumulation of large no. of cases in our courts. Earlier this is done better for the judiciary and the country.
